Terms of Use
These terms of use (“Terms of Use”) regulate the terms of use of the platform and applications (“Services”) provided by Wisera Technology and Information Services Joint Stock Company (“Company”). By accessing or using the Services, you also accept these Terms of Use.
Please read the Terms of Use carefully before using the Services. By not accepting the Terms of Use, you understand and agree that you should not use the Services.
Services
Being able to access the platforms where the Services are provided through application markets or the internet does not mean that you can directly access the Services. You understand and agree that in order to access the Services, you or the institution you are affiliated with must purchase the Services. Even if you access the Services through a trial version, you agree to comply with these Terms of Use.
If you access the Services under the contract(s) between the institution you are affiliated with and the Company, you agree to comply with the rules and limitations specified in the contract(s) in addition to these Terms of Use.
The Company may change and update the Services, certain features of the Services, and methods of accessing the Services from time to time. As a result of these changes, you may need to take certain precautions to continue benefiting from the Services. For example, you may be required to upgrade the software version of the device you use to access the Services, or update your device with an unsupported operating system or operating system version. You acknowledge in advance that the Company shall not be liable for your inability to access the Services due to your failure to take such precautions.
Intellectual Property Rights
All intellectual property rights associated with the Services, including but not limited to software, user interface, trademarks, distinctive signs, codes, and other materials, belong to the Company or its licensors.
You agree and undertake not to engage in reverse engineering, decompilation, or modification of any portion of the Services or any software or other content made available to you for use, and not to engage in any behavior that infringes upon the Company’s intellectual property rights.
User’s Other Obligations
You agree to use the Services in compliance with applicable laws and respecting the rights of third parties.
While using the Services, you agree not to violate these Terms of Use or the rights of the Company or third parties, not to use the Services for any unlawful purpose, not to engage in behaviors that may disrupt the functionality, integrity, and security of the Services and the systems on which the Services are provided, such as cyberattacks, malicious software, virus installation, and unauthorized interventions. You acknowledge and undertake that all liability arising from your use of the Services in violation of the law or these Terms of Use, or from your actions that infringe upon the rights of third parties, belongs to you.
While using the Services, you expressly agree and undertake not to manipulate, reverse engineer, decompile, disassemble, or debug the software, user interface, code, and other elements that make up the Services, and to refrain from any actions that may disrupt the functioning of the system.
You understand and acknowledge that the Services are provided solely for your use for purposes consistent with these Terms of Use. You agree and undertake not to allow unauthorized third parties to use the Services, not to sublicense the Services, and not to use the Services for the benefit of a third party without the Company’s knowledge and consent.
Limitation of Liability
Except in cases where the damage arises from the intentional or gross negligence of the Company, the Company shall have no liability under these Terms of Use or in connection with the provision of the Services.
The Services are provided “as is” and “as available”. The Company makes no express or implied warranties, including but not limited to fitness for a particular purpose, availability, and reliability, regarding the Services.
Termination or Suspension of Services
If the Company determines that you have violated these Terms of Use or engaged in any behavior that may disrupt the functioning of the Services, the Company may suspend or terminate your access to the Services without prior notice.
Non-Commitment
The Company does not make any commitment to enter into a contract with you to provide the Services. The Company reserves the right to refuse your requests to enter into a contract to purchase the Services.
The Company does not make any commitment regarding the provision of trial versions. Your use of the trial version and access to the Services in this manner does not imply a commitment that the trial version will be provided continuously and uninterrupted, or that a contract will be entered into with you for the Services. The Company is authorized to unilaterally determine the terms and conditions of use for the trial version. The Company may reject requests for the provision of trial versions.
Applicable Law and Jurisdiction
These Terms of Use are governed by the laws of the Republic of Turkey, and Istanbul Central (Çağlayan) Courts and Enforcement Offices have jurisdiction over disputes arising from these Terms of Use.
Changes
The Company reserves the right to change, update, or modify these Terms of Use at any time. Unless otherwise expressly stated by the Company, such updates and changes shall become effective upon their publication by the Company.
You understand and agree that you are responsible for keeping track of and reviewing updates or changes to the Terms of Use.
